FAST SETTLE PTY LTD
Effective date: 14 October 2026
1 About this policy
FAST SETTLE PTY LTD (Fast Settle, we, us or our) is a property law firm providing property and conveyancing services in Victoria, New South Wales and South Australia. This policy explains how we handle personal information relating to our website, enquiries and professional services, including information about prospective clients, clients, their representatives and other people involved in a matter.
Personal information is information or an opinion about an identified person, or a person who can reasonably be identified. We handle personal information under applicable Australian privacy requirements. Where the Privacy Act 1988 (Cth) applies to our activities, those requirements include the Australian Privacy Principles. This policy does not change any professional confidentiality obligations that apply to our work.

3 The information we collect
The information we need depends on the enquiry or matter. It may include:
Your name, contact details, property address, enquiry, communication preferences and the information or documents you give us.
Instructions, contracts, title and property records, correspondence, settlement details and information about people connected with the transaction.
Identity and authority details, such as date of birth and identity-document information, where needed to verify identity, authority to act or the right to deal with property.
Financial, payment, tax or residency information relevant to the matter, and information about ownership or the source of funds where required for relevant checks.
4 How and why we collect information
We usually collect information from you through enquiries, forms, documents, meetings or instructions. We may also receive it from your representatives, transaction parties and advisers, lenders, public registers, authorities or matter-related service providers.
We collect information reasonably needed to assess and respond to enquiries, check for conflicts, agree the scope of our work, provide advice and conveyancing services, communicate with relevant parties, arrange settlement, manage our records and meet applicable legal obligations.
Collection may be required or authorised by the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and Rules, electronic conveyancing participation rules or applicable state property, duties and professional requirements. We explain specific mandatory collection in the relevant client or verification notice.
You can make a general enquiry without identifying yourself, or using another name, where lawful and practicable. If we do not receive information needed for an enquiry, identity check or transaction, we may be unable to respond fully, act for you or complete the service.
Provide another person’s information only when authorised or legally entitled, and direct them to this policy where appropriate. Our own privacy responsibilities still apply.
5 Sensitive information and identity checks
A matter may involve sensitive information, such as health information relevant to a person’s capacity or authority. We limit collection to what is reasonably necessary and seek consent where required, unless a legal exception applies. Do not send sensitive information through a general enquiry form unless we specifically request it.
We use triSearch for online identity verification involving identity documents, supporting information and verification results. If the selected method involves photographs, video, facial-liveness analysis or biometric information, we explain the collection and seek consent where required before the check. The verification notice and provider’s privacy information describe the process for your matter.
6 How we use and disclose information
We use personal information for the purpose for which it was collected. We use it for another purpose only with consent or where otherwise permitted by applicable law.
For client matters, we make routine transaction disclosures with client authority, as needed to carry out the matter. Website and communication providers also process information to support our enquiry and client services.
Depending on your instructions and the transaction, relevant recipients may include:
Your authorised representatives, the other party and their legal or conveyancing representatives, real estate agents, lenders and settlement participants.
Land registries, state revenue offices, councils and other authorities where needed for searches, duties, registration or other transaction requirements.
Electronic settlement services, including PEXA, and providers of identity verification, searches or other matter-related services actually used for your transaction.
Our authorised staff and service providers supporting our website, communications, document storage and administration, and professional advisers or insurers where necessary and lawful.
We may also disclose information where required or authorised by law, including to AUSTRAC where applicable, or in connection with a lawful regulatory process. We limit disclosure to information needed for a permitted purpose.
7 Our systems and overseas handling
Our website uses Wix. We use Microsoft services for email, communication and document handling, triSearch for online identity verification, and PEXA for electronic settlement where relevant to a matter.
Our staff are based in Australia.
Website and technology providers may store or process personal information outside Australia. Wix publishes data-centre locations in the United States and Ireland and describes processing by Wix.com Ltd. in Israel and transfers to other Wix entities. These published arrangements mean website information may be handled overseas even though our staff are in Australia.
Wix also publishes storage or processing locations including South Korea and Taiwan, and group-company locations including Brazil, Germany, India, Lithuania, Luxembourg, Mexico, the United Kingdom and Ukraine. The locations relevant to particular information depend on the service and processing involved. You can contact us about the arrangements relevant to your information.
triSearch’s published privacy policy states that data collected for its identity-verification services is not transferred or stored outside Australia. This is a service-specific statement; the overseas handling described above may apply to website information.
Google may also process website advertising and measurement information outside Australia. Google describes its international processing arrangements in its Privacy Policy and data-transfer information.
Where we disclose personal information overseas and Australian Privacy Principle 8 applies, we take the steps required by that principle in relation to the recipient’s handling of the information, unless a lawful exception applies. Contact us if you have a question about the arrangements relevant to your matter.
8 Website information and cookies
When you visit our website, the website and its providers may collect technical information such as your IP address, browser or device information, pages viewed and visit time. Cookies and similar technologies support website functions, security and remembered choices.
We also use Google Ads tags to measure advertising performance through website visits and configured conversion events. These tags can send Google information such as the page URL, IP address, cookie or similar identifiers and event details. Google may use this information to provide and improve its services, measure advertising, prevent fraud and, depending on relevant settings and choices, personalise advertising. See How Google uses information from sites or apps that use our services.
You can manage cookies in your browser settings, although some website features may not work as expected if cookies are blocked. If you follow a link to a separate website or booking service, that provider’s own privacy policy applies to its collection and handling. Our responsibilities for information we send to a provider still apply.
9 Marketing choices
If you subscribe to updates or otherwise agree to receive marketing, we may use the contact details and preferences you give us to send relevant news or information about our services. We will obtain consent where required. You can unsubscribe using the instructions in a marketing message or contact us to stop receiving marketing.
An enquiry or contract upload does not by itself subscribe you to a newsletter. Opting out of marketing does not stop communications needed to respond to your enquiry or manage a matter.
10 Holding and protecting information
We hold personal information in electronic records and, where used, paper files. We take reasonable technical and organisational steps to protect it against misuse, interference, loss and unauthorised access, alteration or disclosure. No method of electronic transmission or storage is completely secure.
11 Retention and data incidents
For matters that proceed to settlement, we generally retain client information for eight years from the settlement date. We may need to retain particular records for longer where required by applicable law, a court or tribunal order, or a continuing permitted purpose such as an unresolved dispute. For enquiries and matters that do not settle, retention depends on the purpose of the record and applicable legal requirements.
When information is no longer needed for a permitted purpose and no law or court or tribunal order requires its retention, we take reasonable steps to destroy it securely or de-identify it. This includes addressing copies held in our systems or by providers under our control.
If a data incident occurs, we will assess and respond to it and notify affected individuals and regulators where required by applicable law. Contact us promptly if you suspect that information provided to us has been accessed or used without authority.
12 Access and correction
You can ask for access to personal information we hold about you, or ask us to correct information you believe is inaccurate, out of date, incomplete, irrelevant or misleading. Use the contact details in section 2. You do not need to use a special form. We may need to verify your identity or your representative’s authority before responding.
We will respond within a reasonable period and provide access in the requested way where reasonable and practicable. There are circumstances in which access may lawfully be limited or refused, including where disclosure would improperly affect another person’s privacy or a legal restriction applies. If we refuse access, we will give written reasons to the extent required or permitted by law and explain how to complain.
There is no charge to request access or correction, or to correct information. If a lawful, reasonable charge is proposed for providing access, we will explain it in advance.
If we do not agree to a correction, we will explain why in writing and how to complain. You may ask us to associate a statement of your disagreement with the information. Where required by applicable law, we will also take reasonable steps, on request, to notify other recipients of a correction.
13 Privacy complaints
Contact us using section 2 if you are concerned about our handling of your personal information. Tell us what happened, when it happened and the outcome you are seeking. We will review the complaint, make reasonable enquiries and provide a response within a reasonable period. If more time is needed, we will explain the reason and the expected response time.
If you are not satisfied with our response, or have not received a response within 30 days, you may be able to complain to the Office of the Australian Information Commissioner (OAIC) where the matter falls within its jurisdiction. See oaic.gov.au/privacy/privacy-complaints or call the OAIC enquiries line on 1300 363 992 for information about the process. Other applicable complaint rights are unaffected.
14 Changes to this policy
We may update this policy to reflect changes to our practices or legal requirements. The current version will be available on our website and will show its effective date. Contact us if you would like an earlier version or have questions about a change.
